Terms of Service
These terms are an agreement between you and ZeusARuse ("we", "us") for your use of Orpheus. By creating an account — where you tick the box confirming you agree — you accept them. Please read them; sections 9 and 10 limit our responsibility, and section 8 involves Spotify. Our Privacy Policy explains how we handle your information and forms part of these terms.
1. Who can use Orpheus
- You must be at least 13 years old, and old enough to hold a Spotify account where you live. If you are under 18, you confirm a parent or guardian has agreed to these terms.
- You need your own Spotify account, and you must follow Spotify's own Terms of Use. Setting up the Spotify app Orpheus works through currently requires Spotify Premium on the account that creates it — a Spotify requirement, not ours.
- One person per account. Keep your password to yourself; you are responsible for what happens under your account.
2. What Orpheus does
Orpheus reads music data you upload — or, if you switch it on, playlists you choose in your Spotify account — and, on the schedule you choose, fills playlists it creates in your Spotify account with selections from it, favouring tracks you have been served least recently. It acts only with the permission you grant on Spotify's approval page, and changes only playlists it creates. Orpheus is an independent tool that adds its own daily playlist; it does not change how Spotify itself works.
Orpheus is provided free of charge. We may change, add or remove features, or suspend or end the service, at any time. We will try to give notice of anything significant, but we do not promise the service will be available at any particular time or at all.
3. Your Spotify app and connection
Orpheus works through a Spotify developer app that you register and own. You are responsible for that app and for complying with Spotify's Developer Terms and Developer Policy as its owner. Requests Orpheus makes on your behalf count toward your app's limits with Spotify. If you use the same app for other tools, their use and ours share those limits, and Spotify may restrict the app as a whole. Spotify may also end your connection — it currently does so six months after approval — and you will need to reconnect.
4. Acceptable use
You agree not to:
- use Orpheus in a way that breaks the law or anyone else's rights, or breaks Spotify's terms;
- upload anything other than genuine music exports you are entitled to use, or anything designed to harm the service or other people;
- try to get into accounts, systems or data that are not yours, probe or test the service's security without permission, or interfere with its operation — including by overloading it;
- use automated means to create accounts or to access the service other than through its pages;
- modify, or create derivative works based on, the Spotify Platform, the Spotify Service or Spotify Content;
- decompile, reverse-engineer, disassemble or otherwise reduce the Spotify Platform, the Spotify Service or Spotify Content to source code or any other human-perceivable form;
- resell, sublicense or offer Orpheus to others as a service.
5. Your data
What you upload remains yours, as do the playlists you have Orpheus read. You give us permission to store and process them only as needed to run Orpheus for you, as described in the Privacy Policy. You can download it or delete it, with your account, at any time from your account page. Track information itself — titles, artists, identifiers and the like — belongs to Spotify, its licensors and the rights holders; neither you nor we acquire any rights in it through Orpheus.
6. Our software
Orpheus's software, design and name belong to us. These terms give you a personal, non-exclusive, non-transferable, revocable permission to use the service for your own, non-commercial listening, and nothing more.
7. Ending your use
You can stop at any time by deleting your account. We may suspend or close an account that breaks these terms or that we reasonably believe puts the service, Spotify or other users at risk; where it is safe to, we will tell you why. Sections 5, 8, 9, 10, 11, 12 and 13 continue after your use ends.
8. Spotify
Orpheus is an independent service. It is not affiliated with, endorsed, sponsored or approved by Spotify. Spotify is a trademark of Spotify AB. Spotify's platform and content are provided by Spotify, which may change or withdraw them at any time — which can stop Orpheus working, in part or entirely, without notice.
We are solely responsible for Orpheus. We make no warranties or representations on behalf of Spotify, and Spotify has no liability to you in connection with Orpheus. Spotify is a third-party beneficiary of these Terms of Service and of our Privacy Policy, and is entitled to enforce them directly against you.
9. No warranty
Orpheus is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement — both for Orpheus and, on Spotify's behalf, for the Spotify Platform, the Spotify Service and Spotify Content. We do not promise that Orpheus will be uninterrupted, timely, secure or error-free, that any playlist will be updated when scheduled, or that data will not be lost.
10. Limits on our liability
To the fullest extent the law allows, neither we nor Spotify will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, playlists, listening history, goodwill or profits, arising from or related to Orpheus, however caused and even if we were told they were possible. Our total liability for all claims relating to Orpheus is limited to fifty US dollars (US$50). Some places do not allow these limits; where that is so, they apply only as far as the law permits.
11. Indemnity
If you use Orpheus in breach of these terms or of the law, and that leads to a claim against us or Spotify, you agree to cover the reasonable losses and costs — including legal fees — that result.
12. Governing law and disputes
These terms are governed by the laws of the State of Florida and applicable US federal law, without regard to conflict-of-law rules. If a dispute arises, please contact us first — most things can be settled by email. Otherwise, you and we agree that disputes will be resolved in the state or federal courts located in Florida, except that either of us may bring a qualifying claim in small-claims court. Nothing here removes any right you have under the consumer-protection laws of the place you live that cannot be waived by agreement.
13. Changes and general terms
We may update these terms. We will change the date at the top and, for a material change, email you at least 14 days before it takes effect; continuing to use Orpheus after that means you accept the new terms. If you do not, you can delete your account. These terms and the Privacy Policy are the whole agreement between you and us about Orpheus. If any part is found unenforceable, the rest still applies. Our not enforcing a term is not a waiver of it. You may not transfer these terms; we may transfer them to a successor operator, who will be bound by them.
